Non-nationals seeking employment in Guyana in the mining sector
Requirements
Every applicant shall provide the Commission with the following information:-
- An endorsement of Application Form for work permit must be obtained from the Guyana Geology and Mines Commission at the cost of $1000. The duplicate forms provided must be completed in BOLD letters using a black ink pen.
- Two COLOURED passport sized photographs of the applicant/Non-national must be submitted along with the Endorsement application form. Only authentic Passport sized photos will be accepted.
- Two COLOURED photocopies of the applicant’s passport i.e. all pages which contain information (stamps, visas, etc.)
- Two COLOURED copies of the sponsor’s passport (Bio data page of individuals).
- A photocopy of company registration, where applicable.
- A copy of dredge licence/s Permit/s or other mining related Licence/s held.
- A copy of Tin Certificates for both Applicant and Employer
- A copy of the Permission to operate dredge or specified machinery, where applicable.
- Applicant’s Certificate of Character/Police Clearance
- Copies of Mining Privileges & or Certificates of Registration for employees operating on the equipment referred to, MUST accompany the application.
- Original copies of the documents listed under item 3 and 4 shall also be presented for inspection. These will be returned immediately after verification by the officer.
- Endorsement of Work Permit Application forms MUST be signed ONLY by the applicant and the Employer. Applications that contain falsified signatures will be cancelled immediately.
- Processing fee of US$50.00 which shall be paid at the time of submission of the Application and all relevant documents.
Sponsorship of Non-Nationals
- Dredges must be registered in the name of the Employer.
- Licences for dredges, Trading Licences, or property holdings must be current at the date of submission of Work Permit applications in order for sponsorship to be considered. In addition, dredge engines must be inspected/certified by relevant personnel.
- Production figures/royalty payments MUST be significant in order for work permits to be considered.
- Individual Employers for Work Permits and companies MUST be Guyanese.
- In cases where production is not declared to the GGMC, official statements complete with letterheads and company seals must be acquired from the company/individual to whom the mineral is declared. This must be attached to work permit documents at the time of submission.
- An alien who has equipment registered in his/her name or who is the holder of a Trading Licence can make an application for self-sponsorship.
- An alien who provides substantial proof to the Commission that he/she is a potential investor may also self-sponsor in order to offset his/her application for the registration of equipment etc. After acquiring his/her approval (of the Work Permit application) from the GGMC and subsequently his/her Work Permit from MOH that alien is allowed to register his/her equipment and to apply for licences etc.
- Permission to Operate Dredge or Specified Machinery must be obtained from the Guyana Geology and Mines Commission in order to facilitate the Work Permit application process.
- The Claim / Permit holder who grants permission for equipment to operate on his/her Mineral Property will be required to sign Work Permit application forms for any alien operating thereon and who may be employed on a dredge that is owned by a non-national.
- The employer must have a work force which comprises AT LEAST 50% Guyanese.
- The claim/permit holder shall forward to the Commissioner monthly, a list of all aliens working on his / her claim/ permit. The claim/permit holder shall not be considered for further processing if he/she is delinquent in this regard.
- The claim/permit holder shall inform the Commissioner of the movement of a dredge from his / her claim/permit.
- The dredge owner shall notify the Commissioner of the movement of his / her dredge from one claim/permit to another.
- The Claim / Permit holder shall inform GGMC and the Ministry of Home Affairs of each alien who ceases to work on his / her claim/permit. The Ministry can therefore cancel the Work Permit issued to that alien under that sponsorship.
- The alien will be required to seek further sponsorship from the new Claim / Permit Holder or a dredge owner who is a Guyanese.
- A sponsor who provides the Commission with incorrect information in relation to sponsorship on claims/dredges shall not be eligible to do sponsorship for one year from the time the misinformation was discovered.
- Sponsorship shall not be granted for any Claim or MP for which Reclamation or environmental Bonds as the case may be are not in force.
- Owners of dredges whose particulars of Registration have not been verified by an Officer of the Commission shall not be entitled for sponsorship of non-nationals who are desirous of working on such dredge.
